§ 1. The Seller
The online shop at bol-met.pl is run by BOL-MET Spółka z Ograniczoną Odpowiedzialnością, registered office: Rogowo 69, 87-515 Rogowo, Poland, entered in the register of entrepreneurs of the National Court Register under KRS number 0001214244 by the District Court in Toruń, 7th Commercial Division of the National Court Register (Sąd Rejonowy w Toruniu, VII Wydział Gospodarczy Krajowego Rejestru Sądowego), tax identification number (NIP) 8921494308, statistical number (REGON) 543587967, share capital 5 000 zł.
Contact: kontakt@bol-met.pl, tel. 507 440 718, every day between 08:00 and 20:00. The address for correspondence and for returns is the same as the registered office.
The Seller is exempt from value added tax under Art. 113(1) of the Polish VAT Act (ustawa o podatku od towarów i usług). The prices shown in the shop are the amounts payable.
§ 2. Which provisions apply to whom
- Consumer, a natural person buying for purposes outside their business activity.
- Sole trader with consumer rights, a natural person running a sole proprietorship who buys in connection with that business, but where the purchase is not of a professional nature for them. Whether it is of a professional nature is assessed against the scope of activity entered in the Polish register of sole traders (CEIDG). Put simply: the owner of a guest house or a workshop buying a carousel will usually be a sole trader with consumer rights; a company that builds playgrounds will not.
- Other Buyers, companies, municipalities, schools, nurseries, co-operatives, residents' associations and other entities buying in connection with activity of a professional nature.
A sole trader with consumer rights has the right of withdrawal (§ 11) and the rights arising from a lack of conformity of the goods with the contract (§ 9) on the terms provided for a consumer; this follows from Art. 7aa of the Polish Consumer Rights Act (ustawa o prawach konsumenta). They are not, however, entitled to help from the consumer ombudsman or from other consumer protection bodies.
§ 3. Services provided by electronic means
- The Seller provides the following electronic services free of charge: browsing the shop content, the cart, the order form, the quote form, the contact form, the referral programme form, the assembly cost calculator, the instalment calculator, the order status page and, where consent has been given, sending commercial information to the email address provided.
- The contract for an electronic service is concluded when you enter the site or start using a given tool, and ends when you leave the site, empty the cart or withdraw your consent. The shop does not require an account.
- To use the shop you need: a device with internet access, a current browser (Chrome, Firefox, Safari, Edge or equivalent) with JavaScript and local storage enabled and, in order to place an order, a working email address. Without local storage the cart will not remember the units you have chosen.
- Using the internet involves the usual risks: interception of transmissions, malware, phishing. The shop runs over HTTPS. The Seller never asks by email for passwords or payment card details, and does not collect such data at all.
- The Buyer must not supply unlawful content, which applies in particular to text entered in form fields (order notes, messages, third party details).
- Complaints about an electronic service (for example a form that does not work, a calculator that gets the sums wrong, an order confirmation that never arrived): send a report to kontakt@bol-met.pl describing the problem. We reply within 14 days. This route is separate from complaints about the goods under § 9.
§ 4. What is sold
The Seller manufactures and sells playground equipment: carousels and seesaws made of powder coated steel. Every unit has a certificate of conformity with the EN 1176 standard and a declaration of conformity.
Units are made after the order is placed, in the colours indicated by the Buyer. The Seller does not sell from stock. Colours are chosen from the Seller's standard palette; on request the unit can be painted in another shade from the RAL palette, and § 11 sets out what such a choice means for the right of withdrawal.
§ 5. Placing an order
- Orders are placed through the form in the shop or by email to kontakt@bol-met.pl.
- Before submitting the form the Buyer sees the list of units, the unit prices, the delivery cost, the assembly cost (if chosen) and the total amount payable. Placing an order carries an obligation to pay, and the button that completes the order is labelled accordingly.
- Placing an order requires acceptance of these terms and conditions.
- After placing an order the Buyer receives an email confirmation with the order number and payment instructions for the method chosen.
- The contract is concluded when the Seller confirms acceptance of the order.
- The Seller sends confirmation of the conclusion of the contract, together with the text of these terms and the information on the right of withdrawal, to the email address provided. That email records the content of the contract on a durable medium, so it is worth keeping.
- The Seller contacts the Buyer to confirm the details, in particular the colours and the date, usually within one working day.
§ 6. Prices and payment methods
The shop does not handle online payments. The following methods of payment are available:
- Bank transfer in advance, we email the transfer details as soon as the order is placed.
- Pro forma invoice with 14-day payment terms, we issue a pro forma invoice and payment is due within 14 days of the invoice. Longer terms are agreed individually.
- Cash on collection in person, payment when you collect the unit in Rogowo.
- Instalments or leasing, we get in touch and match the financing to your situation.
A pro forma invoice with 14-day payment terms is available only to businesses and public bodies holding a tax identification number. Longer payment terms may be agreed individually before the order is placed.
Where bank transfer in advance is chosen, the Seller starts production once the payment has been credited. With a pro forma invoice on deferred terms, production starts without waiting for payment.
Choosing instalments or leasing is not a payment method handled in the shop. It means you agree to the Seller contacting you and setting out the financing options available. The financing contract is concluded separately, with the finance provider, on its terms.
§ 7. Lead time
The standard lead time is 7 working days: 5 working days of production and 2 days of transport. The Seller confirms the exact date when accepting the order.
If the Seller does not hand over the goods by the agreed date, a Buyer who is a consumer or a sole trader with consumer rights may set an additional deadline and, once it has passed without effect, withdraw from the contract (Art. 5431 of the Polish Civil Code, Kodeks cywilny). We refund the amounts paid without delay, and no later than within 14 days.
§ 8. Delivery
- Courier delivery within the territory of the Republic of Poland is free of charge.
- Delivery to the Czech Republic and Slovakia carries a transport surcharge of 1000 zł. The settlement terms are agreed individually before the order is placed.
- The unit is delivered in parts ready for assembly, together with the assembly manual and the full set of documentation.
- Collection in person at the Seller's premises is possible if arranged by telephone in advance.
- The risk of accidental loss of or damage to the goods passes to a consumer and to a sole trader with consumer rights only when the courier hands the goods over to them. For other Buyers the risk passes when the goods are handed over to the carrier.
- We recommend checking the consignment while the courier is there. If damage is visible, a damage report drawn up with the courier makes matters much easier. A consumer and a sole trader with consumer rights lose no rights, however, if they do not draw up a report or if they notice the damage after unpacking: a photo and a message to kontakt@bol-met.pl is enough. Buyers under § 2 point 3 are required to examine the consignment and report any shortage or damage in accordance with Art. 545 § 2 of the Polish Civil Code (Kodeks cywilny) and with Polish transport law (prawo przewozowe).
§ 9. Complaints about the goods: lack of conformity with the contract and the statutory warranty for defects
- The Seller is liable to a consumer and to a sole trader with consumer rights for a lack of conformity of the goods with the contract on the terms of Chapter 5a of the Polish Consumer Rights Act (ustawa o prawach konsumenta). That liability is statutory, independent of the manufacturer's warranty under § 10, and cannot be limited.
- The Seller is liable for a lack of conformity existing at the time the goods are delivered and revealed within 2 years of that time. A lack of conformity revealed within the first 2 years is presumed to have existed at the time of delivery, and it is for the Seller to show otherwise.
- Order of remedies: first repair or replacement (the Buyer chooses, and the Seller may choose the other option if the first is impossible or would involve excessive cost). If repair or replacement is impossible, if the Seller refuses it, does not carry it out within a reasonable time, or if the lack of conformity occurs again, the Buyer may make a declaration seeking a price reduction or withdrawal from the contract. Withdrawal is not available where the lack of conformity is immaterial.
- The costs of repair or replacement, including removal, transport and reinstallation, are borne by the Seller. The Buyer makes the goods available and, where delivering them is excessively difficult because of their weight and size, the Seller collects them at its own cost.
- For Buyers under § 2 point 3, the provisions on the statutory warranty for defects (rękojmia) in the Polish Civil Code (Art. 556 et seq.) apply, with a period of 2 years from the release of the goods.
- How to report: by email to kontakt@bol-met.pl or in writing to the registered office. The report should include the order number, a description of the defect and, if possible, photographs, together with a statement of what the Buyer expects.
- Response times: the Seller responds to a complaint within 14 days of receiving it. No response within that period means the complaint of a consumer or of a sole trader with consumer rights is deemed to be justified.
- Where withdrawal or a price reduction takes effect, the price is refunded within 14 days of receipt of the declaration, by the same means the Buyer used to pay.

§ 10. Manufacturer's warranty
- The Seller grants a manufacturer's warranty (gwarancja) for a period of 2 years from the date of delivery. The warranty is a voluntary commitment by the Seller and does not exclude, limit or suspend the rights under § 9. The Buyer decides which route to take.
- The warranty covers defects in materials and workmanship.
- The warranty does not cover damage resulting from incorrect assembly, use other than as intended, acts of vandalism, or the natural wear of consumable parts.
- Cover under the warranty is conditional on assembly in accordance with the manual and on carrying out the periodic inspections provided for by the PN-EN 1176-7 standard. Failure to meet those conditions does not affect liability under § 9.
- Warranty claims are accepted at kontakt@bol-met.pl or by telephone.
- A person entitled under the warranty may demand repair or replacement; the Seller carries this out within a reasonable time, no longer than 30 days from delivery of the goods or from their being made available at the place of installation.
§ 11. Right of withdrawal
A consumer and a sole trader with consumer rights (§ 2 point 2) may withdraw from the contract within 14 days of taking possession of the goods, without giving a reason. It is enough to send a declaration to kontakt@bol-met.pl or by post to the registered office; the date of sending is what counts.
The right of withdrawal is not available to Buyers under § 2 point 3, that is companies, local government units, schools, nurseries and other entities buying in connection with activity of a professional nature.
Colour choice and the right of withdrawal
Choosing a colour from the Seller's standard palette does not take away the right of withdrawal. In such a case the Seller does not rely on Art. 38(1)(3) of the Polish Consumer Rights Act (ustawa o prawach konsumenta).
If the Buyer orders a unit in a colour outside the palette, a specific RAL code given in the notes or another change made solely to their specification, the unit may be treated as made to their specification, in which case the right of withdrawal does not apply. In that situation the Seller says so clearly before production starts and waits for confirmation. If the Seller does not do so, the right of withdrawal applies on the ordinary terms.
Effects of withdrawal
- The Seller refunds all payments received, including the cost of delivering the goods (for delivery to the Czech Republic and Slovakia, the transport surcharge; for delivery within Poland delivery is free, so there is nothing to refund). If the Buyer chose a more expensive delivery method than the cheapest one offered, the Seller does not refund the difference.
- The refund is made within 14 days of receiving the declaration, by the same means of payment. The Seller may withhold the refund until it receives the goods or proof that they have been sent back, whichever comes first.
- The Buyer bears the cost of sending the unit back, which is around 600 zł. The units are oversized and do not fit on a pallet, so return carriage is handled only by DHL. That amount is an estimate within the meaning of Art. 12(1)(10) of the Polish Consumer Rights Act (ustawa o prawach konsumenta) and may vary depending on the collection address. On request the Seller will give the exact cost before the order is placed, and helps to arrange the return transport.
- The Buyer is liable for any reduction in the value of the goods resulting from using them beyond what is needed to establish their nature, characteristics and functioning. A unit that has been assembled and set in concrete can no longer be returned intact.
- Assembly by the Seller's crew. Assembly is a service. If the Buyer expressly asked for it to be carried out before the withdrawal period expired (which, with a lead time of 7 working days, is usually the case) and the service has been performed in full, the right to withdraw from the assembly contract expires. If assembly was performed in part, the Buyer pays for what was performed up to the moment of withdrawal, in proportion to the scope of the work (Art. 35 of the Polish Consumer Rights Act, ustawa o prawach konsumenta). The Seller gives notice of this effect before the crew sets out.

§ 12. Referral programme
The rules of the referral programme are set out on the referral programme page. By submitting a referral, the Referrer states that they have told the person referred that their contact details are being passed on, and that this person does not object to being contacted by the Seller. On first contact the Seller tells the person referred where their details came from and, at their request, deletes them immediately.
§ 13. Personal data
The Seller is the controller of personal data. How data is processed is described in the privacy policy, and the use of cookies in the cookie policy. Reading these documents requires no consent or acceptance: they are information, not a contract.
§ 14. Out-of-court dispute resolution
A consumer may use out-of-court means of handling complaints and pursuing claims, in particular they may:
- seek free assistance from the district (municipal) consumer ombudsman,
- apply for mediation to the provincial inspector of the Trade Inspection (Inspekcja Handlowa),
- apply to the permanent arbitration court attached to the provincial inspector of the Trade Inspection,
- use the information available on the pages of the Office of Competition and Consumer Protection (uokik.gov.pl).
Using these routes is voluntary and requires the agreement of both parties. The European ODR platform was shut down on 20 July 2025 and is no longer available.
The Seller does not apply a code of good practice within the meaning of the Polish Act on counteracting unfair market practices (ustawa o przeciwdziałaniu nieuczciwym praktykom rynkowym).
§ 15. Final provisions
- Matters not covered here are governed by Polish law, in particular the Civil Code (Kodeks cywilny), the Consumer Rights Act (ustawa o prawach konsumenta) and the Act on providing services by electronic means (ustawa o świadczeniu usług drogą elektroniczną). The choice of Polish law does not deprive a consumer habitually resident outside Poland, including in the Czech Republic and Slovakia, of the protection afforded by the mandatory provisions of the law of their own country.
- Disputes with a consumer and with a sole trader with consumer rights are heard by the court with jurisdiction under the Polish Code of Civil Procedure (Kodeks postępowania cywilnego). Disputes with Buyers under § 2 point 3 are heard by the court with jurisdiction over the Seller's registered office.
- The Seller may amend these terms for important reasons: changes in the law, changes to the payment or delivery methods, changes to the scope of the electronic services, the need to correct an error or an ambiguity, or decisions or recommendations of public authorities. Notice of an amendment is given on the shop website at least 14 days in advance, and by email to people signed up for commercial information. Orders placed before an amendment are governed by the terms in force on the day the order was placed.
- If any provision of these terms turns out to be invalid or ineffective, the remaining provisions stay in force. The relevant provision of the law applies in place of the ineffective one.
